Terms of Service
These Terms of Service govern concrete coating and related services provided by Gemstone Coating to our customers.
These Terms of Service (“Agreement”) govern all concrete coating and related services (“Services”) provided by Gemstone Coating (“Company,” “we,” “us,” or “our”) to the customer (“Client,” “you,” or “your”). By scheduling, authorizing or receiving Services, you agree to these Terms.
1. Services Provided
Gemstone Coating provides professional concrete coating and related surface services for residential and commercial properties.
Services may include garage floor coating, epoxy flooring, polyaspartic coatings, decorative flake systems, quartz systems, metallic epoxy, basement floor coating, patio concrete coating, pool deck coating and related concrete surface preparation.
The specific Services, coating system, colors, finishes and project scope will be agreed upon before work begins.
2. Scheduling & Access
- The Client agrees to provide safe and reasonable access to the property and all areas included in the project.
- The Client is responsible for removing vehicles, furniture, personal property, fragile items and other obstructions from the work area unless otherwise agreed.
- Pets and children must be kept safely away from active work areas, equipment and coating materials.
- If Gemstone Coating cannot reasonably access the work area at the scheduled time, the project may need to be delayed or rescheduled.
3. Pricing & Payment
- Pricing is based on the information available when the estimate or quote is prepared and may change if actual site conditions differ from the conditions originally described or observed.
- Conditions that may affect pricing can include additional concrete repairs, existing coatings, contamination, surface damage or other conditions requiring additional preparation.
- Any material change in project scope or price will be discussed with the Client before additional work is performed.
- Payment requirements, deposits and payment schedules will be stated in the applicable estimate, invoice or written project agreement.
- Late or unpaid balances may result in collection efforts or refusal of future Services.
4. Cancellations & Rescheduling
Clients should provide as much notice as reasonably possible if a scheduled project must be cancelled or rescheduled.
Cancellations, access issues or scheduling changes may affect the project schedule. Any cancellation, rescheduling or deposit terms specified in the Client's estimate, invoice or written agreement will apply to the project.
5. Results & Limitations
Gemstone Coating uses professional preparation methods and coating systems, but the final result can be affected by the condition and characteristics of the existing concrete.
Concrete may contain or develop cracks, movement, moisture-related conditions, previous repairs, staining, contamination or other conditions that affect the appearance or performance of a coating.
Gemstone Coating does not guarantee that pre-existing cracks, imperfections, discoloration, repairs or structural conditions will become completely invisible after coating.
6. Cure Time & Return to Use
Concrete coating systems require time to cure before they are exposed to foot traffic, vehicles, furniture, water, chemicals or normal use.
Cure and return-to-use times can vary depending on the coating system, temperature, humidity, project conditions and application.
Gemstone Coating will provide project-specific guidance regarding when the coated surface can be used. The Client is responsible for following those instructions after installation.
Gemstone Coating is not responsible for damage caused by using the surface before the recommended cure period has passed.
7. Client Responsibilities
The Client must disclose known conditions that may affect the project, including but not limited to:
- Existing coatings, sealers or paint
- Known moisture or water intrusion
- Previous concrete repairs
- Cracks or movement in the slab
- Oil, chemicals or other contamination
- Known drainage or exterior water issues
- Any other known damage or conditions affecting the concrete
Failure to disclose known conditions may affect the project outcome and may require additional preparation or changes to the project scope.
8. Existing Concrete Conditions
Concrete is a naturally variable building material. Existing cracks, movement, settlement, moisture, repairs, surface defects and other conditions may affect the appearance or performance of the finished coating.
Surface preparation and repairs can improve the condition of the substrate but do not convert existing concrete into a new structural slab.
Unless specifically included in the agreed project scope, Gemstone Coating is not responsible for structural movement, new cracking, moisture intrusion or other conditions originating from the underlying concrete or building.
9. Damage & Liability
Gemstone Coating will take reasonable care while performing the agreed Services.
Gemstone Coating is not responsible for pre-existing damage, manufacturer defects, structural concrete conditions or damage caused by conditions outside the agreed scope of work.
To the extent permitted by applicable law, any liability arising from the Services will be limited to the amount paid for the Services giving rise to the claim.
10. Satisfaction & Claims
Any concerns regarding completed work should be reported to Gemstone Coating as soon as reasonably possible after the issue is discovered.
Gemstone Coating reserves the right to inspect the affected area and, when appropriate, determine a reasonable corrective course of action.
The Client agrees to provide reasonable access to the property if an inspection or corrective work is required.
11. Health & Safety
The Client agrees to keep children, pets and unauthorized persons away from active work areas during installation and for any period specified by Gemstone Coating after the coating is applied.
The Client must follow any instructions provided regarding ventilation, access restrictions, cure time and use of the finished surface.
Gemstone Coating is not responsible for issues arising from failure to follow project-specific safety or post-installation instructions.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina.
Any disputes relating to this Agreement or the Services shall be resolved in Wake County, North Carolina, unless otherwise required by applicable law.
13. Entire Agreement
These Terms, together with any applicable estimate, proposal, invoice or other written project agreement, constitute the understanding between Gemstone Coating and the Client regarding the Services.
If project-specific written terms differ from these general Terms, the project-specific written terms will govern that particular project to the extent of the difference.
14. Acceptance
By approving an estimate, scheduling Services, authorizing Gemstone Coating to begin work or allowing Services to be performed, the Client acknowledges and agrees to these Terms of Service.
